YSR Congress Party has faced a setback on Monday in the Supreme Court. Following the apex court’s direction, YS Vijaya withdrew her petition in the Supreme Court seeking transfer of her petition in AP High Court for a CBI probe into alleged misuse of power by Chandrababu Naidu when he was Chief Minister.
The YSR Congress Party honorary president had to take her petition back following the apex court’s rejection to consider her plea for transfer of the case from AP High Court. The Supreme Court asked YS Vijaya to withdraw the petition, failing which the court would have to dismiss the same.
In an application moved before the apex court on December 15 last, Vijaya, who is an MLA from Pulivendula constituency and mother of rebel Congress leader Y S Jaganmohan Reddy, submitted Naidu had deliberately got intervention applications and counsel engaged in the High Court to get several judges recused from the matter.
She said the petition should be transferred to a High Court in any state other than Andhra Pradesh.
However, the SC felt that the convention of ‘not before’ was prevalent in all courts and hence it would be prejudicial to transfer the case on the account. The apex court said that the petition could put forward her apprehensions before the High Court bench, hearing the Chandrababu Naidu case.
The CBI preliminary inquiry into Chandrababu and 7 others ordered by an earlier bench was stayed by another bench of the HC.
YS Vijaya in her petition said, “the petitioner is of bona fide belief that the rest of the appearances would be so organised consistent with the conduct of the unofficial respondents in attempting bench- hopping”.
